1. Agreement to These Terms

These Terms of Service ("Terms") are a legal agreement between you and Adele Fontaine ("Adele Fontaine", "we", "us" or "our"), 200 Airport Rd, Lakewood, NJ 08701, United States. They govern your use of our website, online store and related services (the "Services") and any purchase you make through them.

By accessing the Services or placing an order, you agree to these Terms and to the policies they refer to: our Privacy Policy, Payment & Billing Terms and Return & Refund Policy. If you do not agree, please do not use the Services.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are under that age, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms.

3. Your Account

You may check out as a guest or create an account. If you create an account, you agree to provide accurate information, keep your password confidential and tell us promptly about any unauthorized use. You are responsible for activity under your account. We may suspend or close accounts that break these Terms or are involved in fraud or abuse.

4. Products and Product Information

We try to display our products, colors, fabrics and sizing as accurately as possible. Colors may look different depending on your screen, and slight variations in color, texture and finish are a natural part of many materials. Size guides are provided for reference only. Products are subject to availability, and we may limit quantities or discontinue items at any time.

5. Pricing

All prices are shown and charged in US Dollars (USD) and include applicable taxes and customs charges. Prices may change at any time; the price that applies is the one shown at checkout when you place your order. If an item is listed at an incorrect price, we may cancel the order and refund you, or offer you the item at the correct price, as set out in our Payment & Billing Terms.

6. Orders and Acceptance

Your order is an offer to buy. Your order confirmation email confirms that we received your order; a contract is formed when we ship the items and send a shipping confirmation. We may refuse or cancel any order, in whole or in part, including where items are unavailable, there is a pricing or product error, we suspect fraud or resale, or payment cannot be verified. If we cancel after you have paid, we will refund you in full.

7. Payment

We accept Visa, Mastercard, American Express, PayPal, Apple Pay, Google Pay and Shop Pay. Payment is taken in full when you place your order. You confirm that you are authorized to use the payment method you provide. Full details are in our Payment & Billing Terms.

8. Shipping and Delivery

Shipping is free on all orders delivered within the United States. Orders are processed within 1–3 business days and typically arrive 5–10 business days after dispatch. Delivery dates are estimates, not guarantees, and we are not liable for delays caused by carriers, weather or other events outside our control.

Title to and risk of loss for items pass to you when the carrier delivers them to the shipping address you provided. Please make sure your shipping address is correct; we are not responsible for orders delivered to an incorrect address entered at checkout.

9. Returns and Refunds

Eligible items may be returned within 30 days of delivery. Returns, refunds, cancellations and damaged or incorrect items are governed by our Return & Refund Policy.

10. Intellectual Property

All content on the Services, including the Adele Fontaine name and logo, designs, product images, photography, videos, text, graphics and website layout, is owned by or licensed to Adele Fontaine and protected by copyright, trademark and other laws. You may view and print content for your personal, non-commercial use only. You may not copy, reproduce, modify, distribute, sell or use our content or trademarks without our prior written permission.

11. Reviews and User Content

If you submit reviews, photos, comments or other content ("User Content"), you confirm that it is your own, is accurate and does not infringe anyone's rights. You grant Adele Fontaine a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, edit, display and share your User Content in connection with our business, including on our website and social media. We may remove User Content at our discretion.

If you tag us or use our hashtags on social media, we may ask for your permission before reposting your content.

12. Prohibited Uses

You agree not to:

Use the Services for any unlawful or fraudulent purpose, including using stolen payment details
Buy products for commercial resale without our written consent
Use bots, scrapers or other automated tools to access the Services, collect data or place orders
Interfere with, hack or disrupt the Services or their security features
Upload viruses or other harmful code
Post content that is false, defamatory, obscene, hateful or infringes others' rights
Impersonate any person or misrepresent your affiliation with anyone
Abuse our promotions, discount codes or return policy

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, error-free or free of viruses. Nothing in these Terms limits any warranty or right you have under applicable consumer protection law that cannot be excluded.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, Adele Fontaine AND ITS OWNERS, EMPLOYEES AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO AN ORDER WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT ORDER.

Some states do not allow certain limitations of liability, so some of these limits may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Adele Fontaine and its owners, employees and partners from any claims, losses, damages and expenses, including reasonable legal fees, arising from your breach of these Terms, your User Content or your misuse of the Services.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of New Jersey and applicable US federal law, without regard to conflict-of-law principles.

If you have a concern, please contact us first at info@adelefontaine.com so we can try to resolve it informally. If a dispute is not resolved within 30 days, it will be brought exclusively in the state or federal courts located in New Jersey, and you and Adele Fontaine consent to their jurisdiction. Either party may bring an eligible claim in small claims court. Nothing in this section limits rights you have under applicable consumer protection law.

17. Third-Party Links and Services

The Services may link to or use third-party websites and services, such as payment providers, carriers and social media platforms. We are not responsible for their content, terms or practices, and your use of them is at your own risk.

18. Changes to the Services and These Terms

We may update, suspend or discontinue any part of the Services at any time. We may also update these Terms by posting a revised version with a new "Last updated" date. The Terms in effect when you place an order apply to that order. Your continued use of the Services after changes are posted means you accept them.

19. General

Entire agreement: These Terms and the policies they refer to are the entire agreement between you and Adele Fontaine about the Services.
Severability: If any part of these Terms is found unenforceable, the rest remains in effect.
No waiver: Our failure to enforce any right is not a waiver of that right.
Assignment: You may not transfer your rights under these Terms. We may transfer ours, for example as part of a business sale.
Events outside our control: We are not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, strikes, carrier disruptions or internet outages.
